A legal disclaimer
Customer agrees to use all Vivid Linens rental products (including tablecloths, napkins, pillows, laundry bags, and other rental items, collectively “rental property”) in a careful and proper manner. All renters of Vivid Linens property must schedule the return shipping to Vivid Linens no later than the first business day after the event, unless otherwise specified in the agreement, or extended rental fees may apply. The customer assumes all risk of loss, damage, or abuse to the rental property from any cause and agrees to pay for replacement costs.
Condition, Quality, and Liability
Customer acknowledges that rental property has been selected in size, design, and quantity by the Customer. Vivid Linens makes no express or implied representation, warranty, or covenant regarding the condition, quality, durability, or suitability of the rental property. Vivid Linens shall not be liable for any loss or damage, direct or indirect, caused by the rental property or rental service. Any liability of Vivid Linens is limited to the rental cost.
Property Damage - If rental property is not returned by the agreed date or is returned damaged (torn, burned, or otherwise), the Customer shall pay the replacement cost as indicated in the Vivid Linens Rental Agreement, in addition to any applicable extended rental fees. These charges will be added to the original rental charges and are payable upon receipt of the replacement billing. Credit card payments on file may be charged for all losses and damages incurred.
Inspection - All rental property will be counted and inspected by Vivid Linens upon return. Inspection conclusions are final. Vivid Linens retains ownership of damaged rental property; payment of replacement charges does not transfer ownership to the Customer.
Orders, Returns and Cancellations
Extended Rental Periods - Rental property held beyond the agreed rental period will be subject to extended rental fees. Vivid Linens reserves the right to deem rental property lost, and the Customer will be responsible for replacement fees.
Return Instructions - Rental property may only be returned to Vivid Linens employees or a freight carrier authorized by Vivid Linens. Customer must request and verify reasonable identification before surrendering rental property.
Ordering Errors - Customer is responsible for all costs incurred due to ordering errors, including incorrect dates, colors, quantities, sizes, or duplicate orders.
Order Changes and Additions - Changes to orders can be made before 5:00 pm local time on the Final Confirmation Date. Reductions after this time are not permitted, as the order may have already been packed. Additions after this date may incur separate shipments and additional charges, including expedited shipping if required.
Cancellations - Cancellations after the Final Confirmation Date will result in the loss of the deposit and/or restocking fees, which will be charged to the payment method on file.
Partial Returns - Orders returned partially clean or unused are not eligible for credit and are subject to full rental charges.
Client Responsibilities
Pricing and Availability - Prices and availability are subject to change without prior notice.
Delivery and Pickup - In select locations, Vivid Linens delivery and pickup services help reduce linen loss but do not guarantee recovery of all lost or damaged rental property.
Inspection on Receipt - Customer is responsible for inspecting all orders upon receipt. Discrepancies in shortages, colors, counts, or breakage must be reported to Vivid Linens before the event, with photo documentation and noted on the Bill of Lading (BOL). Once the BOL is signed, the Customer assumes responsibility for the full order unless discrepancies were noted.
Repacking and Care - Customer must properly repack all rental products. Wet or damp linens may result in mold or mildew and associated charges. Customer is responsible for following all Return Instructions. Replacement costs will apply for lost or damaged return bags. Candle wax or other stains on linens will incur damage charges.
Governing Law and Jurisdiction
Customer shall indemnify and hold harmless Vivid Linens from any claims, actions, damages, or liabilities, including reasonable attorney’s fees and court costs, arising in connection with Customer’s use or possession of Vivid Linens’ rental property or services.
Force Majeure - Vivid Linens shall not be liable for delays or non-performance due to circumstances beyond its control, including acts of God, weather, fire, flood, accident, war, civil unrest, or any event preventing performance of obligations.
Media - Customer grants Vivid Linens permission to use photographs of events showcasing Vivid Linens rented materials, in any publications or media. Customer authorizes Vivid Linens to copy, modify, distribute, prepare derivative works from, display, publish, reproduce, and otherwise use such material for business promotion or other lawful purposes. Customer waives rights to inspect or approve the finished product and any claims to royalties or compensation.
Custom Orders & Draping
Custom Orders - Custom orders require final counts at the time of order placement. Full payment and signature of design are required to secure custom fabrics. Availability cannot be guaranteed beyond the date of the quote. Cancellations for custom orders are non-refundable.
Draping - Quotations are tentative and dependant on a site inspection and final rendering of the space to provide a final estinate for aterials and labour.
